Kim Zolciak loses physical custody of her children

Kim Zolciak has lost custody of her children.

The former Real Housewives of Atlanta star divorced Kroy Biermann in May 2023 after 11 years of marriage and after the former NFL player filed an emergency request for permanent physical and legal custody of their four kids, K.J., 14, Kash, 13, and 12-year-old twins Kane and Kaia last month, a judge in Georgia has now made a temporary ruling.

According to documents obtained by E! News, Kim has temporarily lost primary physical custody and while she and Kroy will continue to share joint legal custody, the 40-year-old former sportsman will have the final say when it comes to topics including education, religion, and non-emergency medical decisions.

Kim is now focused on the next court hearing.

She said in a statement: "While I want this process to be over for my children more than anything.

"I am looking forward to a full court date when we will finally be provided with an opportunity to present the truth."

In his emergency request petition, Kroy alleged Kim was "both unstable and unfit" as a parent and is "more selfishly concerned with her own image and her work options than with the opinions of experts and/or the best interest of the children."

But the 47-year-old TV star denied her ex-husband's allegations.

 

Her lawyer told TMZ: "[Kroy's] decision to file this motion lacks factual support and is unwarranted. We will address these claims in the proper legal forum and will vigorously defend the truth in court, rather than through public discourse."

The emergency request came weeks after Kroy had filed for sole custody of the children in March as he claimed Kim had displayed "blatant mismanagement of basic parenting responsibilities" that would be "practically unbelievable to anyone not familiar with the circumstances."

But Kim denied the claims.

She told Us Weekly at the time: "These accusations are completely false and nothing more than a deliberate attempt by Kroy to defame my character.

"I refuse to be bullied or have lies twisted into a narrative about who I am. I will not stay silent; the truth is on my side, and it will come to light--no matter how hard anyone tries to bury it."

At that time, the judge approved a temporary parenting plan whereby Kroy retained the children while Kim completed four sessions of therapy.

After that, they would "resume operation under the existing court-ordered parenting plan, which otherwise remains in full force and effect until further agreement and/or modification by this court."
